Terms of sale

The deal when you buy or download a pack from Design by Raf, in plain English.

The deal when you buy or download a pack from this site, in plain English. Please read it before you buy.

Who you're buying from

Design by Raf is run by Raf Mitchell, a sole trader based in Cardiff, Wales. When you buy from this site, your contract is with me.

Email: raf@rafmitchell.com. I'll reply as soon as I can.

What these terms cover

These terms cover the digital resources on this site (textures, brushes and patterns, sold one by one or in bundles) and the free packs. They don't cover design or automation work for your business: that's always agreed separately, by quote, before any work starts.

Prices and paying

  • Prices are in pounds sterling (GBP) and shown on each pack's page. The price on Stripe's checkout page is the total you pay. I'm not VAT registered, so no VAT is added.
  • Payment is taken by Stripe on its own secure page. I never see your card details.
  • Your order is accepted when Stripe confirms your payment and I email your download link.
  • If a price on the site is clearly wrong (say, £0.45 instead of £45), I'll let you know and you can choose whether to go ahead at the right price or get your money back.

Getting your files

  • Straight after you pay, a download link arrives by email. Each paid link works for 30 days, up to 10 downloads. Free pack links work for 7 days.
  • Please save your files once you've downloaded them. If a link stops working or the email doesn't arrive, reply to your download email or write to raf@rafmitchell.com.
  • Textures are .png files and brushes are .abr files. Each pack's page says what's inside and which apps it works with. Please check that before you buy.

Refunds and your right to cancel

Normally, when you buy online in the UK, you have 14 days to change your mind. With digital downloads that right ends once the download is made available to you, if you've asked for it straight away and agreed to lose the right.

That's what the tick box on the checkout page is for. Before you pay, you tick:

"I agree to the terms of sale and want my download straight away, so I give up the 14-day right to cancel."

So downloads can't be refunded once your download has started.

Faulty files are different. If a file is faulty, won't open, or isn't what the pack's page described, reply to your download email. I'll fix or replace it, and if I can't, I'll refund you. Nothing in these terms takes away your legal rights as a consumer.

What you can do with the files (the licence)

When you buy a pack, or download a free one, you get a licence to use the files. The files themselves, and the copyright in them, stay mine.

You can use them in your own work and in client work, including things you sell, such as prints, products, ads and finished designs.

You can't:

  • sub-license, resell, share, transfer or redistribute the files, whether for free or for payment
  • reverse-engineer them, or use them to create a similar product to give away or sell (for example, your own texture pack or brush set made from mine)

If you're not sure whether something's allowed, ask me first at raf@rafmitchell.com.

Free packs

Free packs come with a simple deal: you join my weekly email (insider tips on the cutting edge of design and AI) and I send you the pack. Pressing Join is what signs you up. You can unsubscribe whenever you like, from any email, and you keep the pack. The same licence applies to free packs as paid ones.

Discount codes

  • When you join the weekly email you get the code WELCOME30: 30% off your first single pack, or an extra 10% off a bundle. Type it in your basket before you pay. It takes off one item per order (whichever saves you more) and doesn't combine with the add-on offer. Bundles are already discounted, which is why the bundle extra is smaller.
  • Codes can't be combined. One code per order, and WELCOME30 never takes the full 30% off a bundle.
  • Codes have no cash value. I may change or end an offer, but never for an order you've already paid for.

Using the site

I work to keep the site and the downloads available, but I can't promise they'll never be down. Free tools on the site, such as the Trust Score, give general guidance about your brand. They're not professional advice for your particular situation.

If something goes wrong

  • If I break these terms, I'm responsible for losses you suffer that were a foreseeable result of it. I'm not responsible for losses nobody could have foreseen when you bought.
  • For anything to do with an order, my total responsibility is limited to the amount you paid for it.
  • Nothing here limits my responsibility for death or personal injury caused by my negligence, for fraud, or for anything else the law doesn't allow me to limit. Your legal rights as a consumer aren't affected.

Changes to these terms

I may update these terms from time to time. The terms that apply to your order are the ones on this page when you bought.

The law that applies

These terms are governed by the law of England and Wales, and any dispute goes to the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring a claim in your local courts.
